Deputy mayor takes reins until new mayor is elected

Tshwane will be led by the deputy mayor, Dr Nasiphi Moya, until a new mayor can be elected following the axing of Cilliers Brink.

Thursday’s council meeting saw councillors debate the motion of no confidence against Brink before it was put to a vote by show of hands: 120 councillors voted for, while 87 councillors voted against, and one person abstained.

Council Speaker Mncedi Ndzwanana said in a letter that Moya would exercise the powers and functions of the office of the executive mayor until council was able to elect a new mayor.

Moya was elected to the deputy mayor position on January 18 during a special council meeting.

Ndzwanana said that in terms of the Municipal Structures Act, 1998, “the deputy executive mayor of a municipality exercises the powers and performs the duties of the executive mayor if the executive mayor is absent or not available or if the office of the executive mayor is vacant.”

“In view of the motion of the vote of no confidence against Brink having been passed on September 26, the deputy mayor, councillor Nasiphi Moya, will exercise the power and functions of the Office of the Executive Mayor until such a time that council convenes to elect a new executive mayor of Tshwane,” he said.

spokesperson of the Office of the Speaker, Sthembiso Sithole explained that the election needed to occur within 14 days of the last council sitting at which it was declared that the position is vacant.

“This means that Council has the responsibility to elect a new mayor within this time frame,” Sithole told Rekord.
