Prosecutor Kholosa Qupha Faces Fraud Charges in Multi-Million-Rand Scheme

A 50-year-old prosecutor, Kholosa Qupha, is facing legal action in connection with a large-scale fraud operation that allegedly defrauded the government through bogus maintenance claims.

The case traces back to October 2012, when suspicions of fraudulent activities by administrative clerks at the Mthatha Magistrate’s Court prompted a formal investigation by the Department of Justice.

According to Provincial Hawks spokesperson, Warrant Officer Ndiphiwe Mhlakuvana, clerks at the court are accused of creating ghost files for non-existent individuals and using these to fraudulently secure unauthorized maintenance payments totalling R700,000 for their own benefit.

After an extended investigation, Qupha, who worked in the maintenance section of the court, was arrested in Plettenberg Bay in 2021 by the Hawks’ Serious Commercial Crime Investigation Unit. She was subsequently brought before the Mthatha Specialised Commercial Crime Court on the same day and released on warning.

Initially, Qupha did not plead guilty, and the court eventually struck her case off the roll. However, following the discovery of new evidence, authorities have reissued summons for Qupha to appear before the court again on March 31, 2025.

While Qupha continues to await her trial, two of her co-accused, Patricia Nobantu Xaki (58) and Victoria Noyolo (54), have already been sentenced and fined in 2021 for their involvement in the fraudulent scheme.
